Los tres años que lleva en vigor la ley que prohíbe la venta de tabaco en los locales de prensa han confirmado las peores expectativas que nos temíamos en su momento. Según datos facilitados por la Asociación Nacional de Distribuidores de Publicaciones (ANDP), 4000 puntos de venta de prensa ha cerrado en estos tres años, con la consiguiente destrucción de empleo. Si bien es cierto, que la prohibición de vender tabaco no es la única causa, sí lo es que en la mayoría de las ocasiones, ha sido un factor determinante.
 

Cuando la rentabilidad de un negocio está en el límite, cualquier descenso en sus ingresos puede ser la gota que colme el vaso.
 

Además no comprendo los motivos que llevaron a establecer esa discriminación con respecto a los bares y quioscos de prensa, por lo que pienso que  es injusta y arbitraria.
 

Estoy de acuerdo en que es inexcusable para los poderes públicos velar por la salud pública y adoptar las medidas pertinentes para proteger del humo del tabaco a los no fumadores e impedir el acceso de los menores a los productos del tabaco, pero prohibiendo la venta en nuestros establecimientos, no se consigue que ningún fumador se plantee dejar ese hábito. Mi experiencia en estos tres años, me dice, que cuando un fumador (y son muchos cada día), se dirige a mi local a pedir su paquete de tabaco y le digo que no puedo vender tabaco, después del momento inicial de sorpresa, la siguiente pregunta es dónde está el lugar más cercano para conseguir su paquete. Creo por tanto que son las limitaciones al consumo y no a la venta, las que pueden predisponer al fumador a plantearse abandonar este hábito tan perjudicial.
 
En mi caso, la situación de crisis en la que estamos inmersos y el consiguiente descenso de nuestras ventas va a provocar, si no lo remediamos, el cierre de mi establecimiento.
 

Creo por tanto que estoy en la obligación de buscar productos y servicios que me permitan dar viabilidad a mi establecimiento y si recuperamos la venta de tabaco, contribuirá sin duda a conseguir dicha viabilidad.
 

Ya en el Real Decreto Ley 2/2006, que modificaba la ley 28/2005, de 26 de diciembre de medidas sanitarias frente al tabaquismo y reguladora de la venta, el suministro, el consumo y la publicidad de los productos de tabaco, y autorizaba la venta de tabaco a través de máquinas expendedoras ubicadas en el interior de quioscos de prensa situados en la vía pública, se justificaba la reforma por la < <necesidad de no causar un perjuicio económico a un sector cuyos ingresos por la venta de tabaco han sido tradicionalmente importantes. La entrada en vigor de la ley ha evidenciado la necesidad de minimizar su impacto, impacto que podría llegar a ser gravoso para un sector modesto como el de los vendedores de prensa.>>
 Pues esto que era cierto para los vendedores de prensa en quioscos de vía pública, también era cierto para los vendedores de prensa en bajos comerciales y tres años más tarde, las consecuencias de no haberlos tenido en cuenta han sido demoledoras.
 

Por todo lo anterior le solicito haga lo que esté en su mano para que los locales de venta de prensa podamos volver a vender tabaco.
 
Confío en su sensibilidad hacia unos profesionales que día a día se esfuerzan por hacer llegar la información a los ciudadanos y sólo le pido que nos devuelva la esperanza de poder seguir viviendo de nuestra profesión.
