La normativa europea es para muchos de sus afectados una gran desconocida, a pesar de cucada vez más su ámbito tiene mayor repercusión en la vida ordinaria de todos los ciudadanos. Los quiosqueros no son, ni de lejos, ajenos a los cambios que esta nueva reglamentación conlleva.La nueva normativa europea, respecto a la adjudicación de las licencias administrativas, entrará en vigor dentro de unos meses y obligará a las Administraciones a realizar concursos públicos para las adjudicaciones de los quioscos/b>, y a estos tendrán derecho, por igual, cualquier persona que se presente, sin importar que haya sido no el concesionario anterior, y rigiéndose la adjudicación por los criterios, fundamentalmente económicos, de cada una de las ofertas.

Ojo a navegantes, parece que los quioscos de Madrid ya se han adelantado a las nefastas consecuencias que puede tener esta normativa para sus actuales concesionarios, Ayuntamientos como el de Barcelona, se encuentran en un acelerado proceso para renovar anticipadamente sus actuales concesiones de quioscos intentando no verse abocados a un Concurso Público, pero es trabajo de las asociaciones de quiosqueros de cada municipio, revisar, con sus respectivos Consistorios, la conveniencia de renovar anticipadamente las actuales licencias de venta de prensa en la vía pública de su localidad.En el detalle os explicamos con mayor detenimiento los principios de la nueva normativa

Un quiosco es una concesión administrativa para uso de la vía pública con el objeto de comercializar diarios, revistas y productos editoriales. Este uso se ha ido ampliando según los criterios propios de cada municipio, y en términos generales cada vez ha abarcado más productos y servicios.

Estas concesiones municipales tienen una duración concreta, la cual también ha venido definida por cada Ayuntamiento, pero que en principio, han sido en todos los casos entre los 15 y los 30 años. Lejos quedaron aquellas licencias que no podían traspasarse, y que se adjudicaban de forma personalísima, transmitiéndose exclusivamente de padres a hijos.

Desde hace mucho tiempo, las administraciones han establecido de común acuerdo con las asociaciones profesionales de vendedores de prensa mecanismos que permitían que las renovaciones de estas licencias se realizasen automáticamente a los concesionarios que las venían explotando, creándose de esta forma una seguridad por parte de estos en la explotación del quiosco que ha llegado a entenderse como “propiedad del quiosquero”.Es precisamente en este aspecto en el que la “Normativa Europea” va a traer importantes cambios para los quiosqueros, ya que, dentro de unos pocos meses, las administraciones ya no podrán utilizar esos criterios continuistas de las adjudicaciones y deberán presentar “Concurso Público” bajo, según el propio Artículo 123, Principios de igualdad y transparencia, asegurando que se “dará a los candidatos un tratamiento igualitario y no discriminatorio y ajustarán su actuación al principio de transparencia”.

　Los criterios para la adjudicación de los quioscos deberán establecerse, según el Artículo 134. “En las proposiciones y la determinación de la oferta económicamente más ventajosa deberá atenderse a criterios directamente vinculados al objeto del contrato, tales como la calidad, el precio,… y cuando sólo se utilice un criterio de adjudicación, éste ha de ser, necesariamente, el del precio”.

Según estos criterios todo empresario interesado podrá presentar una proposición, y los resultados de la adjudicación serán públicos debiendo seguir unos rígidos criterios de publicación en los diferentes boletines.Casos como el de Madrid, ya firmado, o como el de Barcelona que está en proceso de acordarse a lo largo de este año, donde los Ayuntamientos están ofreciendo una gran ayuda a los actuales concesionarios apoyados por sus asociaciones, además de con la renovación de las licencias con apuestas por la innovación de servicios y de los productos a comercializar en los quioscos son un bálsamo para un sector acostumbrado a llevarse lo peor en cada circunstancia.

Todo indica que la renovación de las licencias de quioscos dentro de este año 2.009 será una cuestión de “vida o muerte” para los actuales concesionarios, los cuales pueden ver desaparecer sus negocios en los próximos años si no son capaces de llegar a acuerdos con sus respectivos Ayuntamientos, y debería convertirse en una prioridad para todos aquellos que representan a este colectivo.
