La Comisión de Legislación del Trabajo de la Cámara de Diputados aprobó ayer el polémico proyecto que establece la derogación del Decreto 1025/00 que regula la distribución de diarios y revistas. La iniciativa aprobada por la comisión que encabeza el diputado moyanista Héctor Recalde considera a los dueños de quioscos de diarios y revistas como “trabajadores de la cultura “.El proyecto reivindica los contenidos de un decreto de 1945 (29.045) que dio origen al Estatuto del Canillita y para ello apunta contra el Decreto 1.025 del año 2000. De hecho, el decreto de 1945 no fue anulado por el 1.025 sino por una ley previa, la 24.307 de 1991.
Lo que estableció el decreto 1.025 desde hace nueve años es permitir la venta de diarios y revistas no sólo en los quioscos tradicionales, sino también en otros puntos de venta por fuera de los lugares adjudicados a los “canillitas”, por ejemplo en el interior de locales comerciales.
El proyecto lleva la firma de los legisladores kirchneristas Adela Segarra y Juan Manuel Irrazábal y establece “el carácter laboral” del vÃnculo que los propietarios de éstas paradas mantienen con las empresas editoras de diarios y revistas. Es por esa vÃa -a través del Ministerio de Trabajo- que el Gobierno procura asà regular la distribución de la prensa escrita.
A la vez, el proyecto apunta a eliminar las vÃas alternativas de distribución vigentes desde hace nueve años mediante la creación de una Comisión Tripartita encargada de decidir los requisitos para poder vender diarios, revistas y afines. Esa comisión, según el proyecto, será integrada por “distribuidores, vendedores y empresas editoras”, con lo cual distribuidores y “canillitas” cuentan con mayorÃa para vetar el ingreso de otros competidores.
En sus fundamentos, el proyecto establece que el Decreto 1.025 fue “pauperizando” la actividad de los “canillitas”, como menciona sin distinción a los propietarios de los quioscos y paradas de diarios como a sus empleados. Y agrega que el decreto cuya derogación impulsa “dejó a los “canillitas” a merced de los grandes editores y distribuidores (…) con la nefasta consecuencia de concentración informativa y reducción al pluralismo”.
En ese sentido, el texto identifica a los editores de diarios y revistas con “monopolios” a los que “hay que poner lÃmites”, una terminologÃa que guarda un inequÃvoco paralelo con los argumentos del oficialismo en el reciente debate por la Ley de Medios Audiovisuales.
La iniciativa, si bien cuenta con despacho desde ayer, habÃa sido presentada a principios de 2008 y fue oportunamente refutada por la Asociación de Editores de Diarios de Buenos Aires (AEDBA). Entre otras cosas, AEDBA señaló: “Para nosotros los editores, la venta de diarios y revistas es fundamental (…) pero este respeto no convierte la labor de reventa de diarios (…) en trabajadores de la cultura”.
Los editores de diarios señalaron que en un momento en el que la industria de los medios está en crisis en todo el mundo, aquà se promueve una iniciativa que castiga al sector y va a contramano de polÃticas para este segmento en otros paÃses.
“El artÃculo 4 pretende sujetar la libertad de comercio del editor a lo que resuelva una Comisión Tripartita a crearse (…) Es obvio que el editor, quien hace todo el esfuerzo intelectual, económico y publicitario para poner el diario en venta en la calle, deberá sujetarse a la voluntad de la mayorÃa de la comisión. Eso no solo es ilegal, sino inviable”, sostuvo la entidad.
