Demasiada veces nos hemos lamentado los vendedores de la situación que padecemos.
Hemos presentado a los distribuidores y editores como malévolos explotadores que desprecian nuestra labor.
 

Sin que nadie se sienta ofendido esta actitud es un poco infantil y dice mucho de la pobre mentalidad empresarial que poseemos.
 

Las relaciones entre empresas se miden por su “Poder Negociador”, en el mundo de los negocios no existen malos y buenos eso lo podemos dejar para las películas de Hollywood y está claro que el poder negociador de un solo vendedor es irrisorio.
 

Con este desfase de poderes son lógicas las imposiciones que padecemos, los editores están cómodos ya que además de controlar el pvp están liberados de la presión de las distribuidoras al soportar el vendedor parte o la totalidad de los gastos de transporte, aparte de alejar tensiones sobre las comisiones al distribuidor ya que los distribuidores prefieren apoderarse de una parte de lo que en mi opinión correspondería al vendedor.
 

Con este sistema se dan paradojas curiosas y únicas en el comercio como puede ser que un cliente terminal pueda adquirir una publicación directamente de la editorial a un precio más reducido que el propio vendedor y por supuesto sin gasto de envío.
Este cliente terminal tiene pues más poder negociador que nosotros mismos.
 

Pero ¿Qué produce esta situación?, evidentemente la competencia y la falta de ella.
El cliente puede elegir a que revista suscribirse y esto hace que exista una tensión en el precio. Sin embargo el vendedor depende de las publicaciones y no puede elegir cuales venderá o no, ya que esta elección corresponde al cliente que es el que solicita el producto, tampoco a quien comprarla, ya se cuidan los editores y distribuidores de mantener este status quo.
 

Evidentemente mi intención con esta introducción no es aportar nada nuevo, a partir de esto ¿Qué nos queda por hacer para mejorar nuestro poder negociador?
 

Lo primero seria convencernos de que nuestra fuerza va a radicar en la unión.
 

La situación ventajosa de algunas plazas y vendedores hacen creer a estos que su “situación privilegiada” nunca va a cambiar, pero ciertamente a medida que avanza el Poder Negociador de los distribuidores-editores esto va a ir cambiando, por lo que entiendo que se puede aplicar el refrán de “Cuando las barbas de tu vecino veas cortar..”.
 

Una vez que hemos conseguimos unirnos, ¿Qué herramientas tenemos a nuestro alcance para potenciar nuestro poder negociador?
El conjunto editor-distribuidor piensa que la negociación no le va a reportar ninguna ventaja por lo que por lógica  si accede a negociar no podemos esperar otra táctica que la distracción, y los rodeos para llegar al mismo sitio que nos encontramos. Ya tenemos la experiencia de la negociación con las editoras de coleccionables que a supuesto una autentica burla y tomadura de pelo por el tema de la reducción del tamaño de los cartones.
 

Como decía las herramientas que se me ocurren pasan casi exclusivamente por la presión.
 

La primera vía pasa por igualar las condiciones de los vendedores al menos de la misma plaza, para ello el Art. 2 en su apartado d) es de una claridad meridiana y no permite el trato desigual para la misma prestación de servicio, como ejemplo de esto tenemos la sentencia de Hospitalet que obliga a Distribarna a igualar las comisiones a todos los vendedores precisamente apoyándose en esta ley de la competencia.
 

Los que pagamos portes tenemos en nuestras manos un arma poderosa, la misma que nos debilita. Claro que para ello tenemos que demostrar en primer lugar que lo que estamos pagando realmente son portes o gastos asociados al transporte de las publicaciones al punto de venta.
 

Al tener asociado un gasto a las publicaciones que nos distribuyen ningún tribunal debe obligarnos a recibirlas, lo contario es absurdo, de este modo podíamos listar un número de publicaciones sobre las cuales queremos que se nos transporte excluyendo de facto a las demás, lo que es diferente  a negarse a recibirlas lo que podría incurrir en quebrantamiento de la LDC.
-Si quiere señor distribuidor las  publicaciones fuera de la lista me las hace llegar pero eso sí por otro canal que no me suponga costes, esto es, aparte del reparto cotidiano y por supuesto sin cargos de transporte-.
Esto va a llevarnos a seguir vendiendo lo mismo pues elegiríamos las publicaciones más rentables dejando fuera las de menos interés, créanme que los editores se van a tirar al cuello de los distribuidores.
 

Evidentemente el distribuidor va a hacer caso omiso del llamamiento que debe tener carácter formal, craso error, pues nos va a llevar a demostrar ante los tribunales la falsedad del argumento de los distribuidores sobre los portes ya que demostraría ipso facto que el gran interesado en hacernos llegar estas publicaciones es el propio distribuidor evidentemente empujado por el editor.
 

Para el tema de los márgenes pienso que mancomunar vías de negociación bis a bis con los editores es lo más apropiado, es un tema en el que no debe participar el distribuidor y ningún tribunal puede dictar sentencias en contra del apoyo a una determinada publicación favoreciéndola, por ejemplo situando expositores en línea caliente o repartiendo dípticos que la publiciten.
 

Una línea incierta y peligrosa, que habríamos de dejar como último recurso es el de la asfixia publicitaria, haciendo ver al anunciante –supongo que sabéis como- que en la red existen graves problemas y que su inversión corre riesgo.
