Juez sevillano propone el reparto de la vivienda tras la separación.

Propone la medida para evitar “privilegios” de género y critica el feminismo que apuesta, “no por la igualdad, sino por la perpetuación de una nueva desigualdad” 

El Juez-magistrado de Familia de Sevilla y presidente de la Asociación Española Multidisciplinar de Investigación sobre Interferencias Parentales (Asemip), Francisco Serrano, ha propuesto la redacción de un nuevo texto del artículo 96 del Código Civil, en lo que se refiere a la atribución del uso de la vivienda familiar en casos de ruptura de parejas, con el objetivo de evitar “privilegios” de género y situaciones de “injustificable” discriminación.  

Según ha expuesto el juez Serrano a Europa Press, la reforma y modificación de la redacción de este artículo está “medida en términos de igualdad y pretende erradicar privilegios y consiguientes situaciones de injustificable discriminación”, aunque vaticinó que, por ello mismo, “se va a ver atacada por los representantes de sectores sociales que se van a considerar lesionados en la pérdida de estatus del colectivo al que ilegítima y sectariamente dicen representar”. 

“Por el bien de los niños” 

Así, se refirió a “ese feminismo que apuesta, no por la igualdad, sino por la implantación y perpetuación de una nueva desigualdad basada en el resentimiento y en una falsa ideología de la discriminación de género”, añadiendo que este planteamiento, “considerado políticamente correcto, es egocéntrico y sólo busca el propio beneficio”, cuando los niños de padres separados, “por encima de todo, incluso de su derecho a seguir viviendo cómodamente en el mismo domicilio, a lo que tienen derecho es a la paz familiar y a ser felices con un padre y una madre que no anden a estacazos por cuestiones de índole material”. 

En este sentido, y tras apostar por “conjugar y equilibrar todos los intereses en juego, priorizando el de los menores y eliminando elementos de confrontación y fricción familiar que terminan repercutiendo negativamente en la estabilidad psicológica, emocional e incluso somática de los hijos”, criticó que el poder legislativo “se empeña en vivir de espaldas a la realidad social y sólo se muestra receptivo a posicionamientos carentes de objetividad e impregnados de una perniciosa carga ideológica”. 

“Patrimonio” de las mujeres 

En relación al artículo cuya modificación propone, el juez opina que el legislador “se ha guardado mucho de conservar las reglas de juego que garantizaban erróneamente el inmovilismo en aquellos aspectos considerados como patrimonio de las mujeres, llamadas por su condición sexual a ser las custodias de la prole y, por ende, las titulares del interés familiar preferente que justifica el seguir usando, disfrutando y utilizando el hogar familiar, con independencia de la situación de indigencia en que pudiera quedar el privado de seguir viviendo en la que era su casa”.   

“Se trata de un planteamiento incomprensible, generador de desigualdad, consiguiente injusticia y fuente de conflictos viscerales y, por desgracia, de episodios de violencia doméstica“, según prosiguió el juez Serrano, quien aseveró además que “se han ignorado las situaciones de posible custodia compartida como medida que reduciría esa confrontación y repercutiría en interés y beneficio de todos los integrantes de la familia separada: hijos, padres y madres”. 

En esta línea, abundó en que “la tendencia e inercia ha sido la de entender que la vivienda familiar ha de ser para las abnegadas y sufridas esposas o madres que se separan o divorcian, pues ellas son las llamadas por naturaleza, historia y tradición a la atención de la prole y las únicas llamadas a decidir sobre sus vidas, en un claro exponente de una rancia convicción radical que hace recordar otros respetables principios machistas reflejados en la legislación de la dictadura franquista, que hoy por unanimidad se rechazan”. 

Liquidación de bienes 

Por todo ello, el juez Francisco Serrano propuso una reforma “urgente” y un nuevo texto del artículo 96 del Código Civil, y apostó en primer lugar por liquidar el domicilio y los enseres y ajuar existentes en el mismo, todo ello cuando se ostenten en cotitularidad y bajo cualquier régimen de comunidad de bienes, bien mediante su transmisión a tercero o bien mediante la adjudicación de su propiedad a uno de los cónyuges titulares previa compensación de la cantidad que le corresponda al otro. En todo caso, esa medida procedería cuando se acuerde un régimen de custodia compartida de los hijos, o bien cuando alguno de los hijos quede en compañía de uno y los restantes en la del otro. 

En segundo lugar, y en caso de que existan hijos menores que se encuentren bajo la custodia de uno de los progenitores o mayores que convivan en compañía de uno de ellos y resulten dependientes abogó por adjudicar el uso y posesión al hijo y al cónyuge en cuya compañía queden, pero debiendo limitarse temporalmente esa atribución para facilitar la liquidación del inmueble en los términos indicados anteriormente. 

Así, esa atribución exclusiva temporal, indicó, se realizaría sin perjuicio de que el progenitor no custodio ofrezca contraprestación que garantice el desarrollo de los hijos a una vivienda digna y para atender sus necesidades en forma equivalente a la cobertura que les brindaba la que venían habitando de forma habitual. 

También destaca, entre otras propuestas, aquellas referidas al caso de que no existan hijos o sean mayores e independientes, cuando el uso temporal de la vivienda familiar y hasta que se proceda a su venta o adjudicación de titularidad dominical a uno de los cónyuges corresponderá al que se considere que ostenta el interés familiar más necesitado de protección.
