Estimados compañeros:
Estoy muy preocupado con esta distribuidora ya que tuve que cerrar mi tienda y desde final de Marzo me deben  3000 euros en concepto de depósitos, libros y demás. Mari Trini me aseguró que me mandarían una transferencia que no llega.
No se qué hacer. ¿Me podéis aconsejar?

En principio, entendemos que la fianza a que haces referencia está expresada en el contrato de servicios que suscribiste en su día con la Distribuidora, así como que todo el material que presuntamente te adeudan, lo tienes debidamente documentado.
Sobre la fianza comentarte que atendiendo al artículo 1827 del Código Civil: “la fianza no se presume: debe ser expresa y no puede extenderse a más de lo contenido en ella.” Así pues, si has liquidado tu deuda con esa Empresa, está obligada a devolvértela, sin que eso te dé derecho a reclamar ningunos intereses derivados de la misma, siempre y cuando la cantidad se abone en el momento de finalizar la relación y previa regulación de la situación económica.
En principio, debes realizar la reclamación vía extrajudicial, mediante Burofax con acuse de recibo dirigido a Distribuidora Costa del Sol. En el mismo tienes que detallar las cantidades que te adeudan y los diferentes conceptos. Todo ello lo debes tener debidamente documentado, en prevención de una posible demanda judicial. En el mismo indicarles que tienen un plazo de diez días para ingresarte la cantidad reclamada en la cuenta que  les especificas en el documento de reclamación de deuda.
Si la Empresa se niega a recoger el Burofax o, si aceptándolo, no paga en el plazo indicado, deberás instar demanda de reclamación de cantidades. Para ello necesitas contar con los servicios de abogado/a y procurador/a, ya que la cantidad es superior a 900 euros.
En la demanda Judicial tus representantes incluirán sus gastos y los intereses que haya devengado el retraso en el pago de la deuda (fianza más material).
Nuestra recomendación es que no lo dejes, ya que esa tal Mari Trini, con toda seguridad será una empleada, sin ningún tipo de autoridad, ni representatividad. Por supuesto, una conversación telefónica no tiene validez legal, salvo que ambas partes la reconozcan, pero suponemos que no será el caso.
Referente al coste de la reclamación, si esta llegase a la vía Judicial, no debe preocuparte ya que las costas serán abonadas por la otra parte. No dudes ni un instante. Reclama la deuda y si no recibes respuesta satisfactoria inicia las acciones pertinentes.
Si deseas ampliar la información legal, puedes consultar el Código Civil. Todo lo relativo a las fianzas los tienes en el Título XIV – Capítulos 1822 al 1853. Basta con que escribas “Código Civil” en tu buscador y realices la consulta. El tema es demasiado extenso para incluirlo en la respuesta.
