El Consejo de Ministros aprobó un Real Decreto por el que, en desarrollo de una parte del Estatuto del Trabajo Autónomo, se regula el contrato del trabajador autónomo económicamente dependiente y se crea el registro estatal de asociaciones profesionales de trabajadores autónomos.
Los trabajadores autónomos económicamente dependientes son aquellos cuyos ingresos dependen en, al menos, un 75% de un único cliente. El reconocimiento y regulación de esta figura es uno de los aspectos más novedosos del Estatuto del Trabajo Autónomo, en vigor desde el pasado mes de octubre.
Según destacaron tras el Consejo de Ministros la vicepresidenta primera del Gobierno, MarÃa Teresa Fernández de la Vega, y el titular de Trabajo e Inmigración, Celestino Corbacho, a partir de la regulación de este contrato, unos 250.000 trabajadores autónomos económicamente dependientes, la mayorÃa agentes comerciales, de seguros y transportistas, podrán regularizar su situación.
En la norma aprobada hoy, se regulan las caracterÃsticas de los contratos suscritos por el trabajador económicamente dependiente y su cliente, subrayando la naturaleza civil, mercantil o administrativa que les une (en ningún caso una relación laboral) y clarificando los criterios que determinan su condición de trabajador autónomo económicamente dependiente.
El Real Decreto establece el contenido mÃnimo del contrato que, entre otros aspectos, incluye la determinación de la jornada, los descansos y vacaciones anuales, que al menos serán de 18 dÃas hábiles, asà como el acuerdo de interés profesional que resulte de aplicación.
Además, deberá hacerse constar expresamente que el trabajador autónomo reúne los requisitos para adquirir la condición de económicamente dependiente respecto del cliente con el que contrata.
La norma regula también el registro en el que deberán inscribirse estos contratos, estableciendo que éste deberá ser registrado por el trabajador autónomo económicamente dependiente en el plazo de 10 dÃas hábiles desde su celebración.
REGISTRO ESTATAL DE ASOCIACIONES
Junto al contrato con los autónomos dependientes, este Real Decreto regula el registro estatal de asociaciones profesionales de trabajadores autónomos, que tendrá carácter único para todo el territorio español y dependerá orgánicamente del Ministerio de Trabajo e Inmigración.
En él deberán inscribirse y depositar sus estatutos todas las asociaciones profesionales de trabajadores autónomos que desarrollen su actividad en España, y quedarán excluidas aquellas que tienen principalmente su actividad en una comunidad autónoma (cuando más del 50% de sus asociados tengan su domicilio en un mismo territorio).
El registro será importante para medir la representatividad de las asociaciones de autónomos que formarán parte del futuro Consejo del Trabajo Autónomo.
Durante la rueda de prensa posterior al Consejo de Ministros, De la Vega resaltó que con esta norma, los trabajadores autónomos económicamente dependientes gozarán de mayor seguridad jurÃdica y de más de derechos laborales.
La vicepresidenta subrayó que la economÃa española saldrá de la crisis, “sin renunciar a una sola de las conquistas sociales que los ciudadanos han hecho suyas en los últimos años”. En este sentido, destacó la importancia que tienen los trabajadores autónomos para la economÃa española y garantizó que el Gobierno les seguirá prestando “el apoyo y la atención que se merecen”.
En la misma lÃnea, el ministro de Trabajo manifestó que el Estatuto del Autónomo “marcó un antes y un después y un camino hacia adelante” en los derechos del colectivo de autónomos, por el que el Gobierno, dijo, continuará trabajando.
“Apostamos decididamente por los autónomos y las empresas como fuerza de presente y de futuro”, enfatizó Corbacho, que recordó que se está trabajando para dar al colectivo derecho a cobrar una prestación por cese de actividad. “Esperamos tener pronto alguna conclusión”, apuntó.
