Desde luego, no podemos estar de acuerdo con la caducidad aducida por el distribuidor, dado que el Código penal vigente en su artículo 248 significa estos hechos como incurso en un supuesto delito de ESTAFA y la prescripción la señala el artículo 131 a nuestro juicio en tres años dependiendo de la gravedad en función de la cuantía y situación económica ( artículo 250 del mismo texto legal) en que se deja a la víctima, por tanto, el consejo que te damos es que pongas los hechos en conocimiento del Ministerio Fiscal y en todo caso denuncies los hechos ante el juzgado, pues no estamos ante ningún tipo de vulneración de clausulas de contrato, sino ante un hecho a nuestro juicio totalmente punible. !un saludo compañero !
