El derecho al desempleo y el trabajador autónomo.

Son miles las consultas que nos llegan sobre si el Trabajador Autónomo tiene derecho a las prestaciones por desempleo. En este sentido, debemos decir que la forma de informar al respecto, tanto del Gobierno como de los Ministerios que han hecho uso de esa noticia a lo largo del 2007, tine tintes de “tomadura de pelo” ya que ha dado lugar a crear confusión, a todas luces con la insana intención de “engañar” a los autónomos, ya que es totalmente incierto que el Trabajador Autónomo tenga derecho a ningún tipo de Prestación por Desempleo, salvo en la excepción del “Dependiente”, es decir aquellos se se cubren sus gastos de Seguridad Social, cuando “trabajan” para otras empresas, como es el caso, por ejemplo, de los repartidores. 

Hay que decir que éstos, ademas, tienen obligación de suscribir otras coberturas, como más abajo se indica. 

Debemos recordar, pues es muy importante, que aquellos trabajadores acogidos a protecciones por  desempleo: parados de larga duración, mayores de 52 años, protección familiar, etc. Que se den de baja en ellas y se inicien como Trabajadores Autónomos, perderán los derechos a las mismas, si superan en dos años el tiempo que permanecen de alta en el Régimen de Trabajadores Autónomos. 

Esta información es muy importante, pues miles de desempleados que consiguen independizarse de las prestaciones “mieserables” que en España reciben los denominados “parados de larga duración”, y fracasan en su intento en el Régimen de Trabajadores Autónomos, creen fielmente que después podrán, libremente, reincorporarse si fracasan en su aventura Empresarial, cuando no es así.  

Aconsejamos que acudan a las Oficinas del INEM y reclamen información precisa sobre el tema, ya que después no podrán recucerar el derecho a Prestación de ningún tipo, si no han trabajado un mínimo de tres meses como trabajadores por cuenta ajena. 

A continuación transcribimos un breve resumen del Estatuto del Trabajador Autónomo, que ya remitimos, en su día, a todos nuestros asociados: 

“Recientemente se ha publicado en el BOE la Ley 20/2007, de 12 de Julio, por la que se aprueba el Estatuto del Trabajo Autónomo, a continuación exponemos de forma breve las principales novedades que se establecen en la citada norma: 

  

            Se entiende por “trabajador autónomo” las personas físicas que realicen de forma habitual, personal, directa, por cuenta propia y fuera del ámbito de dirección y organización de un tercero, una actividad económica o profesional a título lucrativo, den o no ocupación a trabajadores por cuenta ajena. 

  

            Se entiende por “trabajador autónomo económicamente dependiente”  a aquellos que realizan una actividad económica o profesional a título lucrativo y de forma habitual, personal, directa y predominante para una persona física jurídica, denominada cliente, del que dependen económicamente por percibir de él, al menos, el 75% de sus ingresos por rendimientos de trabajo y de actividades económicas o profesionales. 

  

-         Se establece un único régimen para todos los trabajadores por cuenta propia. Excepto algunos colectivos específicos encuadrados en otros regímenes de la S. Social. 

-         Obligación para los trabajadores autónomos dependientes de suscribir la cobertura de la Incapacidad Temporal, los accidentes de trabajo y enfermedades profesionales de la S. Social 

-         Establecimiento de prestaciones económicas de la S. Social: por Incapacidad Temporal, riesgo embarazo, maternidad, paternidad, riesgo lactancia, Incapacidad Permanente, jubilación, muerte y supervivencia y familiares por hijo a cargo. 

-         Se permitirá la jubilación anticipada en atención a la naturaleza tóxica, peligrosa o penosa de la actividad, en los términos que reglamentariamente se establezcan. 

-         Por ley se establecerán reducciones y bonificaciones en las cotizaciones 

-         Se establecen reducciones y bonificaciones en la S. Social de autónomos de 30 o menos años de edad.”
